AT&T policies for upgrades/downgrades?

I have an IPhone 3GS and I am eligible for an upgrade. Of course my mom has decided to downgrade my phone to one without a data plan. I was wondering if after I get the other phone, that I get to use my iPhone as an itouch. Because if not then I will have to spend all of my money on a new itouch and music and apps. Please help
